The 1993 Customs Modernization Act (the “Mod Act”) created a partnership between CBP and Trade where CBP guides importers via “informed compliance” publications and the importer exercises reasonable care in its classification, value, quantity, origin and other critical declarations made to CBP in its importations. CBP then monitors importer compliance through post-importation audits. Their current audit vehicle is the Focused Assessment which reviews the importers system of internal controls.
